Whitemarsh Township's Zoning Hearing Board will take up a single live case when it meets at 6:30 p.m. Wednesday, Sept. 2, at the township building.

Lafayette Hill resident Chandra L. Smith is seeking a variance to build a deck at the rear of her home at 2 Cedar Place. Smith's proposal requires relief from Section 116-33.C.(1) of the zoning ordinance, which mandates a 15-foot rear setback. The deck would sit as close as 4 feet, 10 inches from the property line because the rear boundary runs at an angle to the house, according to the application summary prepared by Charles L. Guttenplan, the township's director of planning and zoning.

The setback would range from 8 feet, 8 inches down to 7 feet and then to 4 feet, 10 inches along the angled property line. The township received the application July 23.

A second case on the agenda, ZHB #2026-05, will not be heard Sept. 2. Daniel M. Clark of 316 Whitemarsh Valley Road in Fort Washington had filed validity challenges to Ordinance No. 708, a 1998 floodplain regulation, alleging illegal contract zoning and special legislation affecting a neighboring parcel. Clark's attorney requested a continuance on Aug. 25, pushing the case to Nov. 4.

The five-member board includes members Behr, Doran, Nester, Tone and Weinstein.

Separately, the Board of Supervisors will hold a public hearing Sept. 10 on a proposed data center ordinance. The township said it has not received any data center application and described the ordinance as a proactive measure developed using recommendations from the Montgomery County Planning Commission and a model ordinance from Penn Future. State law prohibits municipalities from banning legal land uses, including data centers, according to the township's announcement.

No data center cases appear on the ZHB's Sept. 2 agenda.
